Ceza Hukukunda elverişsiz teşebbüs

Çalışmamızın konusu olan ''elverişsiz teşebbüs'', ortaya çıkan elverişsizlikler nedeniyle, suçun tamamlanamaması bakımından ceza hukuku bağlamında özel bir yere sahiptir. Esasen, failin tehlikeliliğini toplum düzeyinde sergilemesine rağmen cezai yaptırımın uygulanmaması, öğretide tartışmalara sebebiyet vermiştir. Söz konusu tartışmalar elverişsiz teşebbüsün cezalandırılma sorunu üzerinde yoğunlaşmaktadır. Çalışmamızın gayesi elverişsiz teşebbüs hakkında öğreti ve uygulamadaki görüşlere yer vererek, izahatta bulunmaktır. Buna istinaden, iki bölümden teşekkül eden çalışmamızın birinci bölümünde, ilgili ceza hukuku kurumunun suç genel teorisindeki yeri ve benzer bazı ceza hukuku müesseseleriyle mukayesesi yer almaktadır. İkinci bölümünde ise, elverişsiz teşebbüsün ortaya çıkış biçimleri ve cezalandırılma sorunu mütalaa edilmiştir.

The impossible attempts, which is the subject of our study, has a special place in the context of criminal law in terms of the inability to complete the crime due to the resulting inconveniences. In fact, the fact that the criminal sanction was not applied despite the perpetrator's display of his dangerousness at the community level has led to debates in the doctrine. The discussions in question focus on the problem of punishment of ımpossıble attempts. The aim of our study is to explain the unfavorable enterprise by giving place to the doctrine and practical views. Based on this, the first part of our study, which consists of two parts, includes the place of the relevant criminal law institution in the general theory of crime and its comparison with some similar criminal law institutions. In the second part, the emergence of the unfavorable attempt and the problem of punishment are discussed.
