dc.description.abstractBu çalışmada mülteci ve geçici koruma sağlananların sağlık hakkı, Uluslararası Sözleşme ve Belgeler ve ulusal mevzuat incelenerek belirlenmeye çalışılmıştır. Sağlık hakkına ilişkin inceleme kısmında, sağlık kavramı, insan haklarıyla ilişkisi, sağlık hakkının konusu, öznesi, kapsamı, özellikleri, devletin yükümlülüğü ele alınmıştır. Sağlık hakkına ilişkin Uluslararası Sözleşme ve Belgeler, Türk pozitif hukukunda sağlık hakkına ilişkin düzenlemeler incelenerek Devletin sorumluluğu belirlenmeye çalışılmıştır. Mülteci hukukuna ilişkin incelememizde ise uluslararası hukukta mülteciliğe ilişkin temel kavramlar, uluslararası koruma prensipleri ve mültecilerin hakları Uluslararası Sözleşme ve Belgelerle birlikte ele alınıp değerlendirilmiştir. Mülteci hukukuna ilişkin Türk Pozitif hukukunda 2013 öncesi ve sonrası hukuki düzenlemeler temel kavramlarıyla birlikte incelenmiş, Türkiye'ye kitlesel olarak göç eden Suriyeli sığınmacılara ilişkin hukuki değerlendirmelerin ardından Geçici Koruma Statüsü verilen Suriye vatandaşlarına ilişkin verilen sağlık hizmetlerinin yasal dayanakları değerlendirilmiştir.
dc.description.abstractIn this research, the right to health of the refugees and the ones who are under temporary protection was tried to be determined by analyzing the International Covenants and Documents and, the national legislation. In the analysis part for the right to health, the notion of health, its relation to human rights, the issue, the subject, the extent, the feature of the right to health and, the obligations of the government were discussed. The obligations of the government were tried to be determined by analyzing the International Covenants and Documents and, regulations in the Turkish positive law regarding the right to health. In the analysis for the refugee law, basic concepts in the international law regarding the immigration, international protection principles and refugee rights were discussed together with the International Covenants and Documents. Legal arrangements before and after 2013 regarding the refugee rights in Turkish Positive Law were discussed together with the basic concepts, the legal basis of the health care given to Syrian people who are given Temporary Protection Status after the legal assessment regarding the Syrian refugees migrated to Turkey collectively was evaluated.
