dc.description.abstract6750 Sayılı Ticari İşlemlerde Taşınır Rehni Kanunu, finansmana erişimi kolaylaştırmak amacıyla 1.1.2017 tarihinde yürürlüğe konan ve borçlunun daha geniş kapsamda taşınır varlıklar arasından seçim yaparak ve bu varlıkları alacaklıya teslim etmek zorunda olmaksızın rehin sözleşmesi kurabilmesine imkân tanıyan bir düzenlemedir. Sözleşmenin tarafları, rehnedilebilecek taşınır varlıklar Birinci Bölümde; sözleşmenin tescil edilmesi amacıyla kurulan TARES ve özellikleri İkinci Bölümde; borçlunun temerrüde düşmesi durumunda rehin alacaklısının rehinli varlıkların mülkiyetini talep etme, varlığın kiralama ve lisans haklarını kullanma, alacağını bir Varlık Yönetim Şirketine devretme veya alacağını 2004 Sayılı İcra ve İflas Kanunu genel hükümleri çerçevesinde takip etme seçimlik haklarının tanımlandığı temerrüt sonrası haklar Üçüncü Bölümde incelenmiştir. Çalışmamız boyunca, Kanun kapsamı dışına çıkılmadan, en öz şekliyle içeriğin okuyucuya aktarılabilmesi amaçlanmıştır. Kanun tasarısının sunulması, kanunlaşması ve daha sonraki aşamalar incelenecektir. Amacımız, literatürün dikkatlice taranması sonucunda, değerli yazarların katkılarını ve eleştirilerini de içeren, Kanunun nasıl karşılandığı hususunda doğru ve yalın bir fikir sunabilmek için, genel bir çerçeve çizmektir.
dc.description.abstractThe Code of The Pledge of Movables in Commercial Transactions no 6750 is a regulation put in force on 01.01.2017 to facilitate access to credit by allowing the debtor to establish a pledge agreement for which the debtor may choose from a broader range of movable assets without having to dispose of their possesions to the creditor. The parties of the contract and the movable assets to be encumbered will be examined in the First Chapter; TARES, the registry system effectuated according to the code and its features will be examined in the Second Chapter; the post default rights of the secured creditor to opt for requesting the ownership of the encumbered asset, utilising a leasing or a licensing right of the asset, disposing of the receivable to an Asset Management Company, collecting the receivable under the general provisions set out by The Code of Enforcement and Bankruptcy no 2004 should the debtor defaults will be examined in the Third Chapter. During our study all and utmost attention has been paid not to exceed what falls within the scope of the code in order to be able to provide the reader with convenient knowledge. From the point the proposal was submitted, up until the moment it was ratified and beyond, all stages will be studied. Our main aim is to clearly draw a general frame and when doing so not to miss out any contributions and any oppositions of the writers, the literature has been thoroughly examined to be able to give a true and a brief view of how the code has been welcomed.
