dc.description.abstractSermayenin korunması ilkesine ilişkin tartışmaların gündemde önemli bir yer işgal ettiği dönemde, ilke açık bir ifade ile 6102 sayılı kanunun bir parçası haline getirilmiştir. TTK'nın konuya ilişkin benimsediği sistem, ilkenin ortaya çıkışında etkili olan nedenler ve mukayeseli hukukta ilkeye getirilen eleştiriler dikkate alındığında ilkenin geniş yorumlanmasının mümkün olmadığı görülmüştür. TTK'da yer alan hükümler bu tespite uygun olarak yorumlanmaya çalışılmış, mevcut sorunlara çözümler aranmıştır.
dc.description.abstractThe principle of capital protection was legislated explicitly as a part of Turkish Commercial Code Law No 6102, within the ongoing discussions which occupied a significant place during that period. Acceptance of a broad interpretation of the principle is not desirable regarding the system obtained by the TCC on the principle, determinant reasons on the evolution of the principle and the critiques contented to the principle in comparative law. The provisions of the TCC were interpreted and explanation for the regulations were made in accordance herewith this understanding.
