dc.description.abstractBu çalışmanın konusunu, bir tarafını tüketicinin oluşturduğu abonelik sözleşmeleri oluşturmaktadır. Konunun seçilmesindeki temel etkenler, 6502 sayılı Tüketicinin Korunması Hakkında Kanun'un bir tarafını tüketicinin oluşturduğu abonelik sözleşmeleri bakımından getirmiş olduğu yenilikler, bu yenilikler konusunda yeterli derecede kaynak bulunmaması ve gerek satıcı veya sağlayıcıların gerek abonelerin ve gerekse uygulayıcıların, getirilmiş olan bu yenilikler hakkında bilgilendirilmesi gayesidir. Bu nedenle çalışmamızda gerek 6502 sayılı Kanun'un ve gerekse bu kanun dayanak alınmak suretiyle çıkarılmış olan Abonelik Sözleşmeleri Yönetmeliğinin abonelik sözleşmeleri için öngörmüş olduğu hükümler başta olmak üzere mevzuat hükümleri çerçevesinde, bir tarafını tüketicinin oluşturduğu abonelik sözleşmelerinin tanımı, unsurları, hukuki niteliği, diğer sözleşmeler ile olan benzerlik ve farkları, kurulması, içeriği, tarafların hak ve borçları ile sözleşmenin sona ermesine ilişkin hususlar inceleme konusu yapılmıştır.
dc.description.abstractThe subject of this thesis comprises of Subscription Agreements; a bilateral contract type where one of the contracting parties is the consumer. The main reasons for selection of this subject are that "new rules regarding the subject have been introduced by the Consumer Protection Law no. 6502", "tehere are not enough references on such new rules" and "there is a necessity to inform practitioners, the seller/provider and the subscribes/consumers with regards to such new rules". Accordingly, our study focuses on the relevant legislation, provisions of the Law no. 6502, its application regulations –in particular, the provisions of the Regulation on Subscription Agreements; and examines the definition and components of consumer subscription contracts, its legal characteristics, similarities and differences compared to other contract types, conclusion of contract, and content of the contract, mutual rights and obligations of the parties thereunder and its expiration.
