dc.description.abstractBu çalışmada, Althusser felsefesinde iki yönlü işlev gören hukuk ele alınmıştır. Althusser açısından hukuk, bazen bir baskı aygıtı olarak devletin cezalandırıcı yüzü, bazen de devletin ideolojik aygıtları içerisinde bir eşitlik ve özgürlük teminatı olarak işlev görmektedir. Althusser, toplumsal açıdan üretim kadar yeniden üretim ilişkilerinin de önemine değinmektedir. Ona göre yeniden üretim sadece araçların yenilenmesi değil aynı zamanda bir zihniyetin sürekli yenilenmesidir. Bu süreçte ise hukuk ideolojisi önemli bir yere sahiptir. Hukuk bu anlamda ideolojik bir işlevle kapitalist üretim ilişkilerini soyutlayarak herkesin özgür ve eşit olarak emeğini satmasına ortam hazırlamaktadır. Hukuk ideolojisi tarafından yaratılan bu eşitlik ve özgürlük algısı netice itibarıyla büyük bir adaletsizliğin her defasında yeniden üretilmesini sağlamaktadır.
dc.description.abstractIn this study, law which has a dual function in Althusser's philosophy, is discussed. For Althusser, law sometimes functions as a punishing face of the state as an instrument of oppression, and sometimes as a guarantee of equality and freedom within the ideological apparatus of the state. Althusser mentions the importance of reproduction relations as well as production from a social point of view. According to him, reproduction is not only the renewal of tools, but also the continuous renewal of a mentality. In this process, legal ideology has an important place. In this sense, law, with an ideological function, allows everyone to sell their labor freely and equally by isolating capitalist production relations. This perception of equality and freedom created by the ideology of law, as a result, ensured that a great injustice was reproduced every time.
