| dc.description.abstract | Çevresel etki değerlendirmesi (ÇED), çevre üzerinde olumsuz etkileri muhtemel projelerin hayata geçirilmesinden önce tüm yönleriyle incelenerek, çevreye verebileceği zararların, alınabilecek tedbirlerin ve alternatif yöntemlerin tespiti maksadıyla halkın katılımı ile birlikte yürütülen disiplinler arası bir çalışma ve süreçtir. ÇED sürecinde projeden etkilenecek bölge halkı, konunun uzmanları ve proje sahibinin sağlayacağı bilgi ve değerlendirmeler projenin akıbeti hakkında verilecek kararı etkileyecektir. Bu karar kimi zaman proje için maddi kaynak, zaman ve emek harcayan proje sahibinin aleyhine sonuçlanacak kimi zaman da projeden etkilenecek bölge halkını tatmin etmeyecektir. Bu şartlar altında idari kararın yargı makamları önüne gelerek denetlenmesi gerekecektir. ÇED, idari kararın alınması ve sonuçlarının denetlenmesinde halkın katılımına yer vererek iyi yönetim ilkesini idare hukukuna yansıtmaktadır. Çağdaş bir idari usul müessesi olan ÇED, idarenin çevre ile ilgili kararının ortaya çıkış ve icrasını önceden belirli şekil ve kurallara bağlamakta, böylelikle proje sahibinin ve bundan etkilenecek halkın menfaatlerini korumaktadır. Kuramsal çerçevede önemli bir fonksiyon icra etmesi beklenen çevresel etki değerlendirmesi kavramının ortaya çıkışı, idare hukukuna, idari usule ve idari yargıya yansıması bu tez çalışmasında incelenecek, uygulamadaki sorunlara ilişkin tespit ve çözüm önerilerimiz sunulacaktır. | |
| dc.description.abstract | Environmental impact assessment (EIA) is an interdisciplinary study and process carried out in order to identify and predict the potential environmental impacts of an investment project and propose means to avoid or reduce the significant impacts. Public participation, the involvement of consultants, and the proponent (investor) during the decision-making process are the main principles of EIA. All the information gathered during the process and evaluation helps the authority at decision making. Unless the positive decision of the authority the proponent can't obtain the permits and licenses to initiate his project. So the final decision can be disadvantageous for the project owner, who spends financial resources, time, and effort. O the other hand sometimes the decision may not satisfy the public that will be affected by the project. Both situations cause a legal conflict that has to be judged at the administrative jurisdiction. The public participation function of EIA ensure reflecting the principle of good governance to the administrative law. EIA, which is a contemporary administrative procedure institution, secure the emergence and execution of the administration's environmental decision to certain rules, thus protecting the interests of the project owner and the public. The development of the concept of environmental impact assessment, its reflection on administrative law, administrative procedure, and administrative jurisdiction will be examined in this thesis, and our determination and solution suggestions regarding the problems in practice will be presented. | |
