| dc.description.abstract | Kat karşılığı inşaat sözleşmelerinde yüklenici, taahhüt ettiği yapıyı sözleşmede kararlaştırılan ve dürüstlük kuralının gerektirdiği niteliklere uygun şekilde meydana getirmek ve arsa sahibine teslim etmekle yükümlüdür. Aksi takdirde arsa sahibine karşı ayıba karşı tefekkül hükümlerine göre sorumluluğu söz konusu olur. Arsa sahibinin yüklenicinin ayıptan doğan sorumluluğuna gidebilmesi için birtakım şartların gerçekleşmesi gerekir. Bu şartlar; yapının teslim edilmesi, yapının ayıplı olması, muayene ve ihbar külfetlerinin yerine getirilmesidir. Bu şartların sağlanması halinde, arsa sahibi ayıplı ifa nedeniyle yükleniciye karşı, sözleşmeden dönme, bedelden indirim isteme, ayıbın giderilmesini isteme şeklindeki seçimlik haklara sahip olur. Ayrıca arsa sahibi genel hükümlere göre tazminat isteyebilir. Yapıdaki ayıbın arsa sahibine isnat edilebilecek bir sebepten doğması, yapının arsa sahibince kabul edilmiş olması veya zamanaşımı sürelerinin geçmiş ve yüklenicinin de zamanaşımı definde bulunmuş olması hallerinde ise, yüklenicinin ayıptan doğan sorumluluğu ortadan kalkar ve dolayısıyla arsa sahibi ayıptan doğan haklarını kaybeder. Çalışmamızda yüklenicinin teslimden sonraki ayıplardan doğan sorumluluğu bu kapsamda incelenmiştir. | |
| dc.description.abstract | In construction agreements in return for independent units, the contractor is obliged to complete the works in a proper and workmanlike manner as shown on the contract documents and deliver to the landowner. Otherwise, the contractor has responsibility against landowner in accordance with the provisions of contemplation. Some specific requirements must be fulfilled in order to apply for the responsibility of the contractor because of defection. Those requirments are; delivery of the building, the defect of the building, the fulfillment of the inspection and notification burdens. If these conditions are met, landowner will have optional rights against the contractor due to the defective performance, such as abrogation of the contract, requesting a discount, and requesting the removal of the defect. In addition, landowner may request compensation according to blanket clause. Contractor's responsibility arises from the defect automatically ceases and the landowner loses his/her rights in the case that the defect in the building is born due to a reason that can be attributed to the land owner, the building has been accepted by the landowner, or limitation period expires and the contractor claims for refutation. The aim of this thesis is to evaluate the responsibility of contractor arising from defects after delivery. | |
