dc.description.abstractBu çalışmada Türk Borçlar Kanunu'nda yer alan ve borcun kaynaklarından biri olan sebepsiz zenginleşme kurumunu değerlendirdik. İade borcunun türleri ve iadenin kapsamı bakımından bir incelemede bulunduk. Sebepsiz zenginleşmenin hukukun ve uygulamanın birçok alanında kullanıldığını gösterdik. Bu çalışmada ayrıca başka hukuk sistemlerinde sebepsiz zenginleşme kavramının nasıl değerlendirildiğinden de kısaca bahsettik. Böylece, Türk Hukuku'nda yer alan uygulamanın diğer hukuk sistemleriyle fark ve benzerliklerini değerlendirdik. Ayrıca, sebepsiz zenginleşmenin diğer uygulamalarla ilişkisini, bu uygulamalarla benzerlik ve farklarını ortaya koyduk. Çalışmamızın ikinci bölümünde ise iade borcunun türlerini ve iadenin kapsamını açıkladık.
dc.description.abstractIn this study, we evaluated the unjust enrichment institution which is one of the sources of the debt in the Turkish Code of Obligations. We have examined the types of return debt and the scope of the return. We have discussed that unjust enrichment is used in many areas of law and practice. In this study, we also briefly talked about how to evaluate the concept of unjust enrichment in other laws. Thus, we have evaluated how this practice in Turkish Law is similar to other laws. In addition, we showed the relationship of unjust enrichment with other applications, similarities and differences with these applications. In the second part of our study, we explained the types of return debt and the scope of the refund.
