dc.description.abstractBu çalışmanın temel amacı, idarenin kusursuz sorumluluğuna neden olan tehlike (risk) ve sosyal risk ilkelerinin incelenmesidir. Betimleyici kaynak taraması yöntemi ile hazırlanan bu çalışmada üzerinde durulacak temel sorular, kusursuz sorumluluk kavramının ne olduğu, tehlike ve sosyal risk ilkesi kapsamında hangi durumlarda idarenin kusursuz sorumluluğuna hükmedilebileceğidir. Çalışma kapsamında elde edilen bilgiler, idarenin eylem ve işlemlerinde kusurlu olduğu durumlara ilişkin yasal düzenlemelerin yanında, kusursuz olmasına rağmen tehlike ve sosyal risk gereği ortaya çıkan zararlardan dolayı da sorumlu olduğunu ortaya koymuştur. Buna literatürde kusursuz sorumluluk ilkesi denilmektedir. Araştırmada, tehlike ve sosyal risk kapsamında idarenin sorumlu tutulabilmesi için, idarenin işlemleri ile ortaya çıkan olay arasında illiyet bağının kurulması, zararın ortaya çıkmadan önlenebilmesi noktasındaki beklentinin idare tarafından karşılanamamış olması ve bahsedilen zararın toplumsal hayatta yaşamanın bir sonucu olarak ortaya çıkması durumları ile ilgili tartışmalara yer verilmiştir.
dc.description.abstractThe aim of this study is to examine the principles of risk (risk) and social risk that lead to the absence of strict liability of the administration. The main questions to be addressed in this study, which is prepared by the descriptive method, are the meaning of the concept of strict liability and under which circumstances it is possible to assume strict liability of the administration in the framework of the risk and social risk principles. The information obtained within the scope of the study suggest that administration is responsible for damages arising out of danger and social risk, even though it is impeccable, besides the legal regulations regarding cases where the administration is defective in their actions and transactions. This is called the principle of strict liability in the literature. The study included a discussion of the fact that in order to be able to be held responsible in the framework of the danger and social risk, the relationship between the actions of the administration and the incident occurred should be found, the expectation from the administration could not be met that the damage could be prevented by the administration before it emerges and the socalled damage arises as a consequence of social life.
