Yabancıların temel hak ve özgürlüklerinin bireysel başvuru yoluyla korunması

Abstract

Ulusal bir başvuru yolu olarak Anayasa Mahkemesine bireysel başvuru yolu, yürürlüğe girdiği 2012 yılından itibaren temel hak ve özgürlükler bakımından Türkiye'de önemli ilerlemelere vesile olmuştur. Tezde, yabancıların temel hak ve özgürlükleri belirtilen değişim perspektifi çerçevesinde yeniden ele alınmıştır. Bu doğrultuda, yaşam hakkı, işkence ve kötü muamele yasağı, özgürlük ve güvenlik hakkı, adil yargılanma hakkı, etkili başvuru hakkı konusunda yabancılık statüsü ile bağlantılı ihlal iddialarına Anayasa Mahkemesinin sergilediği tutum mercek altına alınmış, eleştiriler getirilerek öğretiye katkı sunulması amaçlanmıştır. Bu yapılırken, Avrupa İnsan Hakları Mahkemesinin ilgili kararlarına da temas edilmiştir.

Since its entry into force in 2012, the individual application to the Constitutional Court has led to achieving significant progress in Turkey, in terms of fundamental rights and freedoms, as a domestic remedy. In this thesis, fundamental rights and freedoms of foreigners have been re-examined within the framework of this perspective of change. Accordingly, the Constitutional Court's attitude to allegations of violations related to the right to life, the prohibition of torture and ill-treatment, the right to liberty and security, the right to a fair trial, and the right to an effective remedy have been examined, and criticisms have been brought to contribute to the doctrine. Meanwhile, the relevant judgments of the European Court of Human Rights' were also touched upon.
