Yardım veya bildirim yükümlülüğünün yerine getirilmemesi (TCK M. 98)

Abstract

Çalışmamızın konusu olan yardım veya bildirim yükümlülüğünün yerine getirilmemesi suçu 5237 sayılı TCK'nın 98'inci maddesinde düzenlenmiştir. Kendini idare edemeyecek durumda olan kişiye hal ve koşulların elverdiği ölçüde yardım etmeyen veya bu durumu derhal ilgililere bildirmeyen kimse bu madde uyarınca cezalandırılır. Çalışmamızın gayesi yardım veya bildirim yükümlülüğünün yerine getirilmemesi suçu hakkında doktrin ve uygulamadaki görüşlere yer verilerek izahatta bulunmaktır. Buna istinaden, iki bölümden teşekkül eden çalışmamızın birinci bölümünde ilgili suç tipinin tarihi vetiredeki gelişimi, mukayeseli hukuktaki düzenleniş şekli ve benzer suçlarla mukayesesi yer almıştır. İkinci bölümde ise yardım veya bildirim yükümlülüğünün yerine getirilmemesi suçu ve yapısal unsurları mütalaa edilmiştir.

Crime of "failure to help or notify" which the subject of our study, is regulated in article 98 of TCK (Turkish Penal Code). Within the scope that the circumstamces permit, those who does not provide assistance to the person in need or immediately notify the relevant parties about the condition, shall be punished under this article. The purpose of our study is to explain the arguments which takes part in doctrine and case law about the crime of "failure to help or notify". Accordingly, in the first part of our study, which consists of two chapters, the progress of this crime in the historical process, its position in comparative law and its comparison with similar crimes take place. In the second part, the crime of "failure to help or notify" and its elements are scrutinized.
