Anayasacılık ve kutuplaşmış toplumlarda anayasa yapımı

Abstract

Anayasa yapımı taşıdığı önem nedeniyle sıklıkla ele alınan bir konudur. Bununla birlikte, anayasa yapımı konusu incelenirken çoğunlukla bazı toplumsal farklılıkların göz ardı edildiği görülmektedir. Esasında kimi toplumlarda diğer toplumlara göre çok daha fazla sorunun mevcut olduğu ve bu sorunların anayasa yapımını da etkilediği ortadadır. Bu nedenle kutuplaşmış toplumlar olarak isimlendirilebilecek bu toplumlardaki anayasa yapımı sürecinin ayrıca ele alınması gerektiği açıktır. Nitekim doktrinde de bu yönde çalışmalar mevcuttur. Diğer taraftan, anayasacılık fikri, anayasa kavramının ortaya çıkıp gelişmesinde belirleyici bir düşüncedir. Bu bağlamda, kutuplaşmış toplumlarda anayasa yapımının anayasacılık düşüncesi çerçevesinde ele alınması, yol gösterici ve yeni sonuçlara götürücü nitelikte olabilecektir.

Constitution making is a subject that is often discussed because of its importance. Nevertheless, when the issue of constitution making is examined, it is seen that some societal differences are often overlooked. In fact, there are much more problems in some societies than the others, and these problems also influence constitution making. For this reason, it is clear that the constitution making process in these societies, which can be called divided societies, should be handled separately. Indeed, there are supporting studies in the doctrine. On the other hand, constitutionalism is a decisive considertion in the emergence and development of the notion of constitution. In this regard, the handling of the constitution making in the divided societies in the context of constitutional thought may be guiding and leading to new conclusions.
