Tebligat kanunu çerçevesinde elektronik tebligat

Abstract

Tebligat, hukuki işlemlerin yetkili merciler tarafından kanunlarda belirtilen usullere uygun olarak ilgilisine (muhatap ya da muhatap yerine kabule yetkili kişilere) elektronik ortam dahil olmak üzere yazı ya da ilan yoluyla bildirilmesi ve yapılan bilgilendirmenin belgelendirilmesidir. Elektronik tebligat ise, Elektronik Tebligat Yönetmeliği m. 3/1- ç uyarınca, Tebligat Kanunu ve bu Yönetmeliğe uygun olarak elektronik ortamda gerçekleştirilen tebligattır. Elektronik tebligat, 2011 yılında Tebligat Kanunu'na getirilen m. 7/a ile düzenleme alanı bulmuştur. Söz konusu düzenleme uyarınca, elektronik tebligat kullanımı, zorunlu ve isteğe bağlı olarak ikiye ayrılmaktadır. Elektronik Tebligat Yönetmeliği m. 9 gereğince, tebligat çıkarmaya yetkili makam ve merciler tarafından UETS'ye (Ulusal Elektronik Tebligat Sistemi) gönderilen elektronik tebligat mesajı, UETS tarafından muhatabın elektronik tebligat adresine ulaştırılmaktadır. Mevzuatımızda elektronik tebligatta tebliğ tarihi, muhatabın elektronik tebligat adresine ulaştığı tarihi izleyen beşinci günün sonu olarak belirlenmiştir. Elektronik tebligat usulü, usul ekonomisi ilkesine hizmet etmesinden çevrenin korunmasına kadar birçok faydayı beraberinde getirmektedir. Bunun yanı sıra elektronik tebligata ilişkin çözüme kavuşturulması gerekli birtakım sorunlar söz konusudur. Son yıllarda meydana gelen değişikliklerle elektronik tebligat zorunluluğu kapsamının genişletilmesi ve buna bağlı olarak kullanımının yaygınlaşması nedeniyle çokça gündeme gelen elektronik tebligat hususu, önemini ve güncelliğini korumaktadır.

Notification is notifying of legal transaction by the competent authorities to the relevant person (to the addressee or to the persons authorized to accept on behalf of the addressee) by writing or announcement including electronic media, in accordance with the procedures expressed in the laws, and documenting information provided. Electronic notification, according to Electronic Notification Regulation art. 3/1- ç, is the notification that is carried out in electronic media in compliance with Notification Law and this Regulation. Electronic notification was regularized with the amendment of Notification Law art. 7/a in 2011. According to aforementioned regulation, the use of electronic notification is divided into two as obligatory and optional. In compliance with Electronic Notification Regulation art. 9, the electronic notification message sent to UETS (NENS, National Electronic Notification System) by the authorities and authorities authorized to issue notification is delivered to the addressee's electronic notification address by UETS. In our legislation, the date of notification in electronic notification is determined as the end of the fifth day in pursuit of the date when the notification reaches the electronic notification address of the addressee. The procedure of electronic notification brings many benefits from contributing procedural economy principle to protecting the environment. However, there are several problems concerning electronic notification that need to be overcome. The case of electronic notification that has been on the agenda by the reason of the expansion of the scope of electronic notification obligation and accordingly widespread use, with the changes that have occurred in recent years, maintains its importance and keeps up-to-date.
