Türkiye'de cinsiyet değiştirme işlemlerinin tıbbi ve hukuki yönden değerlendirilmesi

Abstract

Kişinin doğarken edinmiş olduğu fiziksel özelliklerine bağlı cinsiyetine uygun hissetmemesi, cinsel kimliğinin fiziksel cinsiyetinden farklı olması transseksüellik olarak adlandırılmaktadır. Transseksüel bireyler Türkiye'de ve dünyada gerek cinsiyet değiştirme operasyonları olma konusunda, gerekse ameliyat olsun yahut olmasın özgürlüklerini, haklarını kullanma konularında birçok farklı muameleye maruz kalmaktadırlar. Bu çalışmamızda transseksüel kimselerin tercih etmeleri durumunda cinsiyet değiştirme operasyonları olmaları, hukuki kimliklerini değiştirmeleri, sahip oldukları yahut sahip olmaları gereken hakları kullanmada karşılaştıkları güçlükleri Türkiye'deki hukuki düzenlemeler, emsal kararlar ve tarihsel gelişmeler ışığında inceleyeceğimiz gibi Dünya'da da farklı ülkelerde trans bireylerin karşılaştıkları durumlara yer vereceğim. Çalışmamızın ilk bölümünde ameliyatlara, ikinci ve üçüncü bölümünde Türkiye'deki hukuksal anlamda tarihsel gelişmelere ve emsal kararlara da yer vererek Türkiye'deki transseksüellerin hukuki pozisyonu ile devamında cinsiyet değiştirmenin üreme, evlatlık, evlilik, velayet (genel olarak aile hukukuna göre sonuçları), isim değiştirme, hakları kullanma, hısımlık gibi sonuçlarına ve dördüncü bölümde de dünyadaki duruma değineceğiz.

It is called transsexuality that the person does not feel suitable for his / her gender due to his / her physical characteristics at birth and that his / her sexual identity is different from his / her physical gender. Transgender individuals are subjected to many treatments in terms of exercising their freedom and rights even if they want to have sex-change operations or not. In this study, I will examine; what are the difficulties may face if a transgender person prefers sex-change operations or to change their legal identity and using the rights to possess in the light of the regulations, the supreme court's decisions and the historical developments in Turkey and also we will examine in the light of the situations faced by transgender people in different countries place. In my study, the first section is about the sex-change surgeries, in the second and third part I will give a place about the historical developments, precedents in the legal sense in Turkey on the legal position of transsexuals in Turkey, and I will mention about the consequences of gender reassignment such as reproduction, adoption, marriage, custody (the consequences according to family law in general) and changing names, using rights and kinship. In the fourth chapter, I will point on the situations in the World.
