Bunlardan ilki mimarlık projeleri; ikincisi ise mimarlık eserleridir. Mimarlık projeleri FSEK kapsamında ilim ve edebiyat eserleri kategorisinde sayılmıştır. Mimarlık eserleri ise güzel sanat eserleri kapsamındadır. Mimarlık projelerinin ilim ve edebiyat eseri sayılarak korunabilmesi, sahibinin hususiyetini taşıyan bireysel bir yaratım olması şartına bağlıyken; yapıların mimari eser olarak korunabilmesi aynı şartın yanında estetik niteliğini haiz olmasını da gerektirir. Mimarlık projelerinde ve mimarlık eserlerinde değişiklik yapılması FSEK’in eserde değişikliğe ilişkin 16. maddesi kapsamında mümkündür. Ancak mimari eserlerde işlevsellik unsurunun bulunması, eser sahibinin izni olmadan değişiklik yapılmasının sınırlarını genişletmektedir.Intellectual effort can be categorized as intellectual work in two cases. Architectural projects are the first category and the architectural works are the second one. Architectural projects have been considered as "scientific and literary" works according to "Law of Intellectual and Artistic Works". Architectural projects should carry the characteristic of the author and should include individual creativity to be able to benefit from the protection of Law of Intellectual and Artistic Works. Additionally, architectural works should have aesthetic value to be able to benefit from the protection of the Law. Modification of the architectural projects and works is allowed to according to the 16 provision of Law of Intellectual and Artistic Works.
