Hemen belirtelim ki, makalemizin konusu, söz konusu kiracı şirket ile taşınmazın maliki olan bir ilçe belediyesi ve kira sözleşmesinin kiraya veren tarafını oluşturan şirket arasında görülmekte olan ve karar düzeltme aşamasındaki bir uyuşmazlık nedeniyle, 6100 sayılı Hukuk Muhakemeleri Kanununun 293. maddesi kapsamında, tarafımızdan hazırlanan özel bir hukukî mütalâanın da konusudur.In this article, we will examine the issue that if the owner of a real estate could want the evacuation of the leased real estate, if the right of usufruct is cancelled, by the demand of usufructuary, before the expiration of the deadline. We must say that, the subject of the article, is also a legal opinion, given by us, within the scope of Article 293 of Code of Civil Procedure, as part of a case that is on the revision of the decision instance.
