Her toplum, mutlaka düzenli şekilde bulunmalıdır. Çünkü toplumun mutluluk ve refahı düzenli yaşam neticesinde gerçekleşir. Toplum düzeni ise birlikte yaşamı sağlayan kurallar bütünüyle mümkündür. Bu kuralların ihlali halinde, yaptırımların uygulanması gerekecektir. Aksi takdirde toplumun birlikte yaşamasını sağlayan kuralların sürekli ihlali kaçınılmaz olacaktır.Birlikte yaşayan insanların en üst organizasyonu olan devlet, düzenli toplumsal yaşamı sağlamak için toplum tarafından kınanan eylemleri suç olarak belirlemek ve suç karşılığında ceza öngörmek zorundadır.Cezalandırmanın klasik amacı caydırıcılık olsa da suç işleyen kişilerin topluma yeniden kazandırılması ve suç işleyen kişiye verilecek cezanın yine topluma fayda sağlayacak nitelikte olması da günümüzde hayli önem kazanmıştır. Zira çağdaş ceza hukuku anlayışında suçlu şahsa verilecek her cezada suçun genel anlamda mağduru olan toplumun ön planda tutulması gerekmektedir. Çünkü cezalandırılacak her kişi toplumu oluşturan en küçük yapı taşı şeklinde bir bireydir.Bu kapsamda suçlu kişilere işledikleri suçlar kapsamında verilen kısa süreli hapis cezasına seçenek yaptırımlar büyük önem arz etmektedir. Seçenek yaptırımlar, kısa süreli hapis cezalarının suçlu ve toplum bakımından zararlı sonuçlarını en aza indiren ve toplumun menfaatini ise üstün tutan niteliktedir. Dolayısıyla kısa süreli hapis cezalarına seçenek olarak uygulanan yaptırımlar konusu, ulusal ve uluslararası hukukta ilgi çekici konumdadır. Yukarıda bahsedildiği üzere, seçenek yaptırımlar suçlunun cezalandırılmasının yanı sıra topluma yeniden kazandırılmasını ve dolayısıyla toplumun yüksek menfaatini de gözetmektedir. Every society must be present in an orderly manner. Because the happiness and well-being of the society occur as a result of regular living. The social order, on the other hand, the rules that ensure coexistence are entirely possible. Violations of these rules will result in sanctions. Otherwise, the constant violation of the rules that allow society to live together will be inevitable.The state, which is the highest organization of the people living together, has to determine the actions condemned by the society as crimes and prescribe punishment in return for the crime in order to ensure orderly social life. Although the classical purpose of punishment is deterrence, reintegration of the offenders into the society and the punishment to be given to the perpetrator to be beneficial to the society has also gained importance today. Because, in the understanding of contemporary criminal law, the society, which is the victim of the crime in general, should be prioritized in every punishment to be given to the guilty person. Because every person to be punished is an individual in the form of the smallest building block that makes up the society. In this context, alternative sanctions to short-term prison sentences given to criminals within the scope of their crimes are of great importance. Alternative sanctions are of a nature that minimizes the criminal and harmful consequences of short-term prison sentences and upholds the interests of society. Therefore, the issue of sanctions applied as an alternative to short-term prison sentences has become interesting for all national and international legal systems. As mentioned above, alternative sanctions protect the reintegration of the offender into society, and therefore the best interests of the society, as well as punishing the offender.
